These terms and conditions govern your use of datalists.co.uk (the "Site"), operated by DEMC Digital Limited, a company registered in England and Wales ("DataLists", "we", "us", "our").

By using the Site you agree to these terms in full. If you do not agree with any part of these terms, please do not use the Site.

1. About the Site

DataLists is a directory of B2B data providers. We provide a platform for buyers to browse provider listings and submit data briefs, and for data providers to list their services. DEMC Digital Limited does not itself supply, hold, warrant or take responsibility for any data provided by companies listed on the directory.

2. For buyers

Free to use. There is no charge to submit a brief or browse the directory.

No guarantee of response. Submitting a brief does not guarantee you will receive a response, a quote, or a dataset. DataLists acts as an introduction service only and cannot be held responsible if a provider does not respond.

Your compliance responsibility. Any data you purchase through a connection made via DataLists must be used in full compliance with UK GDPR, the Data Protection Act 2018, PECR, and all other applicable laws. DEMC Digital Limited accepts no liability for how you use data purchased from providers found through the Site.

Accuracy. You agree to provide accurate and truthful information when submitting a brief and to use a valid business email address. Submissions from personal email addresses (gmail, hotmail, yahoo etc) are not accepted.

3. For data providers

Free listings are available to any legitimate B2B data provider operating in compliance with applicable data protection law. DEMC Digital Limited reserves the right to decline, suspend or remove any listing at its sole discretion without notice.

Featured listings are subject to a separate commercial agreement and payment terms as confirmed in writing at the time of upgrade. Featured listing fees are non-refundable once the listing has gone live.

Your responsibility for accuracy. Providers are solely responsible for ensuring their listing information is accurate, current and not misleading. DEMC Digital Limited accepts no liability for inaccurate or outdated provider information.

Compliance requirement. All providers listed on DataLists must operate in compliance with UK GDPR, the Data Protection Act 2018 and all applicable data protection and marketing legislation. DEMC Digital Limited reserves the right to immediately remove any provider found or reasonably suspected to be operating non-compliantly.

4. Intellectual property

All content on the Site including text, design, logos, code and database structure is owned by or licensed to DEMC Digital Limited. You may not reproduce, distribute, modify or create derivative works from any Site content without our prior written permission.

Provider listings remain the intellectual property of the respective providers. By submitting a listing you grant DEMC Digital Limited a non-exclusive, royalty-free licence to display your company information on the Site and in related marketing materials for the duration of your listing.

5. Limitation of liability

DataLists is a directory and introduction service only. DEMC Digital Limited is not a party to any transaction between buyers and providers and accepts no liability for:

  • The quality, accuracy, legality or fitness for purpose of any data supplied by listed providers
  • Any loss or damage arising from use of data purchased through a connection made via the Site
  • Any failure by a provider to respond to a brief or deliver a dataset
  • Any indirect, consequential or special loss including loss of business, revenue, profits or data
  • Any interruption or unavailability of the Site

To the maximum extent permitted by law, our total aggregate liability to you in connection with the Site and these terms shall not exceed £100.

6. Acceptable use

You agree not to use the Site to:

  • Submit false, misleading or fraudulent briefs or listing applications
  • Harvest contact details or data from the Site for unsolicited marketing purposes
  • Circumvent, disable or interfere with any security or access controls
  • Use automated bots, scrapers or crawlers to extract data from the Site
  • Upload or transmit any malicious code, virus or harmful content
  • Infringe the intellectual property rights of DEMC Digital Limited or any third party

We reserve the right to suspend or permanently ban any user or provider found to be in breach of these acceptable use terms.

7. Third party websites

The Site contains links to third party websites including provider profile websites. These links are provided for convenience only. DEMC Digital Limited is not responsible for the content, privacy practices or reliability of any third party website and does not endorse any linked site.

8. Availability

We aim to keep the Site available at all times but do not guarantee uninterrupted access. We reserve the right to suspend, withdraw or modify the Site at any time without notice for maintenance, updates or any other reason.

9. Governing law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to these terms

We may update these terms at any time by posting the revised version on this page. The date at the top of this page reflects the last update. Your continued use of the Site after any changes constitutes your acceptance of the updated terms.
